This book discusses internationalization of petroleum agreements worldwide in which it has attempted to provide a balance ‘legal’ analysis drawn from various sources that include, inter alia, petroleum laws, legal theories, courts’ interpretations and decisions, legal publications of highly qualified publicists and ‘real-life’ international energy contracts. A relevant international arbitration case study on Indonesian geothermal energy project “Karaha Bodas Company (KBC) v. Pertamina” is presented to provide valuable insights on material contractual provisions and enforcement.
All references—except energy contract documents—are obtained from primary sources of reasonable quality/accuracy. Provisions of the contract between KBC and Pertamina are obtained from secondary sources cited in courts decisions/publications as contract is confidential document in which even expired or terminated one is arguably has the residual power to influence the course of current and future negotiations.
In a summary, this study reaches the conclusion that there are four strategies in which internationalization of energy agreement has been done.
